WLS-TV in Chicago reports: Monday night, a tree crashed on several homes in the East Beverly area of Chicago, injuring one individual enough to send them to the hospital.

A big tree crashed through roofs on the city’s South Side and remained there on Tuesday morning.

The severe winds caused the enormous tree to break and crash into a house, resulting in damage to both it and the neighboring structure.

“His front yard and later ours were ruined when the tree fell.. In addition, we’ll require a new roof and some drywalling on the interior, but otherwise, everyone is doing OK “house owner Steve Klinsky remarked.

  • According to CFD, a 48-year-old man was sent to Little Company of Mary hospital and is doing well.
  • The residences were checked by city officials, who gave the all-clear to allow residents back inside.
  • More damage must be assessed by Tuesday morning when residents may do so in daylight.
  • The National Weather Service reported at least two brief EF-0 tornadoes in the Chicago suburbs on Monday morning.
  • Chicago building inspectors were needed to determine the structural integrity of the damaged residences.
  • It occurred on Monday night at midnight in the 1700 block of West 101st Street.

A fence may be considered a private nuisance in Massachusetts under section 21 of Chapter 49 of the General Laws.

Any fence or structure that serves the same purpose as a fence that is more than six feet tall and is installed or maintained maliciously with the intent to cause substantial harm to the owners or inhabitants of adjacent land is considered a private nuisance.

Definition Of “Public Shade Tree” Under Section 1 of M.G.L.

Any tree planted in a public right-of-way or within its confines must serve as a public shade tree.

Until the opposite is demonstrated, the tree is considered to be on public property and part of the highway if there is any uncertainty about its location.

Removal Of Public Shade Trees, Section 3, M.G.L.

No person, including the owner of the fee in the land on which such tree is situated, shall cut, trim, or remove, in whole or in part, any public shade tree without first obtaining a written permit from the tree warden or his deputy, except as provided in subsection (5) of this section.

The penalty for damaging another person’s trees is “imprisonment for not more than six months or… a fine of not more than five hundred dollars,” according to Section 11 of MGL

To the tune of three times the amount of damages awarded therefor, violators “are accountable to the owner in tort.”

This constitutes an act of vandalism. To remove wood, nuts, berries, and fruit is also covered. The criminal could face a monetary fine or jail time, depending on the severity of the crime.
